Smart Browser Terms and Conditions

These Terms and Conditions ("Terms") apply to the Smart Browser app for Android (the "App"), made by Irfan Habeeb ("I", "me", "we" or "us"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App and uninstall it.

1. The App

Smart Browser is a web browser for Android. Along with browsing, it includes tools such as ad and tracker blocking, private tabs, a password manager, reader mode, Read Aloud, page translation, downloads, offline pages, PDF tools, a document scanner, an image studio, a QR code scanner and generator and a developer console. Features may be added, changed or removed over time.

2. Who can use the App

You may use the App if you are at least 13 years old, or the minimum age required in your country to use such an app without a parent's consent. If you are younger than that, you may use the App only with the involvement and permission of a parent or guardian.

3. Your licence to use the App

The App is free. Subject to these Terms, we give you a personal, free, worldwide, non exclusive, non transferable and revocable licence to install and use the App on devices you own or control, for your own personal use.

You agree not to:

• Copy, sell, rent, sublicense or redistribute the App, or publish modified copies of it.
• Reverse engineer, decompile or disassemble the App, except where the law allows this despite this restriction.
• Remove or change any copyright, trademark or other notices in the App.
• Use the App's name, icon or branding to suggest that something you make is from us or endorsed by us.

4. Acceptable use

You are responsible for how you use the App and for the websites you visit with it. You agree not to use the App to:

• Break any law that applies to you, or help anyone else do so.
• Access, download or share content that is illegal, or that infringes someone else's copyright or other rights.
• Gain unauthorised access to any website, account, network or computer system.
• Harass, harm, defraud or impersonate any person.
• Spread malware or interfere with the normal working of any website or service.

5. Websites and third party services

Smart Browser shows websites that are owned and run by other people. We do not control, check or endorse those websites, and we are not responsible for their content, accuracy, safety, availability or privacy practices. Your use of any website is between you and that website, under its own terms.

Some features rely on services run by others, including your chosen search engine, Google Translate, Google's site icon service, Wikipedia, public filter list publishers and Android System WebView. These services are provided by their owners under their own terms and privacy policies. They may change, limit or stop working at any time, and when they do, the related feature in the App may stop working too.

6. Ad blocking and privacy features

The ad blocker, cookie popup hiding, third party cookie blocking, HTTPS Only Mode, Global Privacy Control and similar features are offered to improve your experience and privacy, but none of them can promise to block everything. Some ads or trackers may get through, and some websites may not work correctly while these features are on. You can turn these features off in Settings, and turn the ad blocker off for a single site.

Global Privacy Control asks websites not to sell or share your data. Whether a website respects that request is up to the website and the laws that apply to it.

7. Translation and other tools

Translations are produced automatically by Google Translate and may be inaccurate or incomplete. Please do not rely on them for legal, medical, financial or other important decisions. Similarly, files made with PDF Tools, the Document Scanner, Image Studio and the QR code generator are produced automatically, so please check them before you rely on or share them.

8. Your data and passwords

Your browsing data, saved passwords and files are stored on your device and are under your control, as explained in the Smart Browser Privacy Policy, which forms part of these Terms. We have no copy of your data, so we cannot recover it for you. You are responsible for:

• Keeping your device secure, including using a screen lock.
• Keeping any backup files you export safe, especially backups that include saved passwords, which are stored in plain text.
• Making your own backups of anything important. Data can be lost if the App is uninstalled, its data is cleared, your device is reset or lost, or "Clear data when quitting" is turned on.

9. Downloads and content you save

You are responsible for the files you download, save or create with the App, and for making sure you have the right to download, keep and share them. Files from the internet can contain harmful software, so only open files from sources you trust.

10. Our content and ownership

The App, including its design, code, name, icon and artwork, belongs to Irfan Habeeb and is protected by copyright and other laws. These Terms do not give you any ownership of the App. The App also includes open source software, fonts and filter lists, each of which is provided under its own licence. You can see them in the App under Settings, About, Open source libraries, and those licences apply to those parts in place of these Terms where they differ.

11. Updates

We may release updates to fix problems, improve security or change features. Some updates may be needed for the App to keep working properly. We are not obliged to provide updates, support or any particular feature, and we may stop offering the App at any time.

12. Feedback

If you send us ideas, suggestions or feedback about the App, you agree that we may use them freely to improve the App, without any obligation to you.

13. No warranty

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of fitness for a particular purpose, accuracy, security or uninterrupted, error free operation. We do not guarantee that the App will be free of bugs, will work with every website or device, or will keep your data from being lost. Some countries do not allow certain warranties to be excluded, so some of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, Irfan Habeeb will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, passwords, files, profits or goodwill, arising from your use of, or inability to use, the App or any website or service you reach through it, even if we were told such damages were possible. Because the App is free, our total liability to you for any claim relating to the App is limited to the amount you paid for it, which is zero. Nothing in these Terms limits any liability that cannot be limited by law.

15. Indemnity

You agree to protect Irfan Habeeb from claims, losses and costs (including reasonable legal fees) that arise from your misuse of the App or your breach of these Terms, to the extent permitted by law.

16. Ending these Terms

You can stop using the App at any time by uninstalling it, which also removes the data it stored on your device. Your licence to use the App ends automatically if you break these Terms. Sections 8, 10 and 13 to 18 continue to apply after these Terms end.

17. Changes to these Terms

We may update these Terms from time to time, for example when the App changes or when the law requires it. The updated Terms will be posted on this page with a new date at the top. Continuing to use the App after a change means you accept the updated Terms.

18. Governing law

These Terms are governed by the laws of India. Any dispute relating to the App or these Terms will be subject to the exclusive jurisdiction of the courts in India, unless the law of the country where you live gives you the right to bring a claim in your local courts.

19. General

If any part of these Terms is found to be invalid or unenforceable, the rest will remain in effect. If we do not enforce any part of these Terms, that does not mean we give up the right to do so later. These Terms, together with the Smart Browser Privacy Policy, are the whole agreement between you and us about the App.
